Making Decisions for Others
When a family member or friend loses the mental capacity to make their own decisions—whether due to dementia, a stroke, brain injury, or severe learning disabilities—it can be an incredibly distressing time.
If they have not previously made a Lasting Power of Attorney (LPA), nobody has the automatic legal right to manage their finances, pay their bills, or make decisions about their care. Even spouses can find their bank accounts frozen.
In these situations, the Court of Protection exists to safeguard the interests of people who lack capacity. Our specialist team, led by Nicola Casey, can help you apply for a Deputyship Order, granting you the legal authority to act on their behalf.
How We Help
Applying to the Court of Protection involves detailed forms, medical assessments, and strict reporting duties.
We handle the entire application process for you, dealing with the Court and the Office of the Public Guardian (OPG) to ensure your appointment as Deputy is approved as quickly as possible.
Our Specialist Services
Comprehensive legal support for Deputies and families.
Deputyship for Property & Finance
This order authorizes you to manage the person's financial assets. This includes paying care home fees, managing bank accounts, selling property, and claiming benefits on their behalf.
Deputyship for Personal Welfare
In certain complex cases, the Court may appoint a Deputy to make decisions about medical treatment or where a person lives. These are less common than financial orders and require specific legal justification.
Statutory Wills
If a person lacks the capacity to make a Will, their estate may pass under Intestacy Rules which might not reflect their wishes. We can apply to the Court to make a 'Statutory Will' on their behalf to protect beneficiaries.
Professional Deputyship
If there are no suitable family members or friends able to act, or if the estate is high-value and complex, a Partner at Hetts can be appointed as a Professional Deputy to manage affairs impartially.
